Terms of Use

These Terms of Use ("Terms") are an agreement between you and Sacred Pathway LLC ("Sacred Pathway", "we", "us") for the AI Marcus mobile app and related services ("AI Marcus"). By creating an account or using AI Marcus, you agree to these Terms and to our Privacy Policy at https://www.sacredpathwayllc.com/ai-marcus-privacy-policy. If you do not agree, do not use AI Marcus.

1. Eligibility and accounts

• You must be at least 13 years old to use AI Marcus.
• If you are under the age of majority where you live, you may use AI Marcus only with the involvement of a parent or guardian who agrees to these Terms.
• You are responsible for your account, for keeping your login secure, and for activity under your account.
• Give accurate information, and don't create accounts for anyone else or impersonate others.

2. AI features

• What it is. AI Marcus includes an AI assistant powered by OpenAI, a third-party AI provider. Before anything is sent to OpenAI, you'll be asked for permission, and you can turn sharing off any time in Profile > AI Data Sharing. See the Privacy Policy for what is shared.
• Accuracy. AI responses are generated automatically and may be inaccurate, incomplete or out of date. They are not professional legal, financial, tax, medical or other advice. Review them carefully and get professional advice for important decisions.
• Your inputs and outputs. You keep whatever rights you have in what you send to the AI assistant. As between you and Sacred Pathway, you may use the AI-generated text and images you receive for any lawful purpose. Similar outputs may be generated for other users. We don't promise that outputs are unique or free of third-party rights, so check before you use an output commercially, for example as a logo.
• Acceptable use. Don't use the AI features to create content that breaks these Terms or the law, to harm others, or to try to get around safety limits. Usage limits apply.

3. Gigs Marketplace

• A meeting place only. The Gigs Marketplace lets users list services ("gigs") and contact each other. Sacred Pathway is not a party to any agreement between buyers and sellers. We don't employ sellers, guarantee their work, or verify their skills or identity.
• No payments through AI Marcus. We don't process payments, hold funds, or provide escrow, refunds or dispute resolution between users. Any payment is arranged directly between users, at their own risk. Use good judgment before paying anyone.
• Your responsibility. Sellers are responsible for their listings, pricing, delivery, taxes and following the law. Buyers are responsible for checking whether a seller is right for them.
• Reviews. Reviews must be honest and based on a real completed order.

4. Your content

"Your Content" means anything you submit to AI Marcus, including:

• Profile and seller profile details.
• Gig listings and portfolio items.
• Images, project information, messages, requests, replies and reviews.

You keep ownership. You own Your Content. We do not claim ownership of it.

License you give us. You grant Sacred Pathway a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format and moderate Your Content. This license is only for operating, providing and improving AI Marcus, including showing your public marketplace content to other signed-in users.

• It ends when you delete Your Content or your account.
• We may keep copies where needed to comply with the law, enforce these Terms, or keep records of reports and moderation decisions.
• We may let our service providers (such as hosting and, if you agree, OpenAI) process Your Content on our behalf to provide the service.

Your promises. You confirm that:

• You own Your Content or have the rights needed to post it and grant this license.
• Your Content doesn't infringe anyone's intellectual property, privacy or other rights.

5. Prohibited content and conduct (zero tolerance)

You may not post, send or offer:

• Sexual or pornographic content, or sexual services.
• Hateful, harassing, threatening, violent or abusive content.
• Content that sexualizes or endangers minors.
• Illegal goods or services, including drugs, weapons, counterfeit items, fake IDs, stolen or hacked accounts, malware or hacking services.
• Scams, fraud, fake reviews, fake credentials, spam or misleading listings.
• Content that infringes someone else's copyright, trademark or other rights.
• Other people's private information without permission.

You may not:

• Harass, threaten or abuse other users.
• Get around blocks or suspensions.
• Misuse the reporting system.
• Interfere with the app's security.

6. Reporting, blocking and moderation

• Report. You can report any gig or user from inside the app. You can also contact us at support@sacredpathwayllc.com.
• Block. You can block any user. Blocked users' content is hidden from you, and pending requests between you are closed.
• Screening. We automatically screen marketplace text for prohibited content.
• Review. We review reports, and we may remove content, remove gigs, or suspend or end accounts that break these Terms, with or without notice.
• No monitoring duty. We are not required to monitor all content, and we are not responsible for user content. We may still act on any content at our discretion.
• Copyright complaints. To report content that infringes your copyright or other rights, email support@sacredpathwayllc.com with the details, and include the gig or user involved.

7. Ending your use

• You can stop using AI Marcus and delete your account at any time in Profile > Delete Account.
• We may suspend or terminate your access if you break these Terms, or if needed to protect users or comply with the law.
• Sections 4 (for retained copies), 8, 9, 10 and 11 survive termination.

8. Disclaimers

AI Marcus is provided "as is" and "as available".

• To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
• We don't guarantee the app will be uninterrupted or error-free.
• We don't guarantee that AI outputs or user content will be accurate, legal or reliable.
• We don't guarantee any outcome from dealing with another user.

9. Limitation of liability

• To the fullest extent allowed by law, Sacred Pathway is not liable for:
  • Indirect, incidental, special, consequential or punitive damages.
  • Loss of profits, data or goodwill.
  • Any dispute, payment or loss between users.
• Our total liability for any claim relating to AI Marcus is limited to US $50.
• Some places don't allow these limits, so they may not fully apply to you.

10. Indemnity

You agree to cover Sacred Pathway's losses and costs, including reasonable legal fees, from claims arising out of:

• Your Content.
• Your use of AI Marcus.
• Your dealings with other users.
• Your breach of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Alabama, USA, without regard to conflict-of-law rules, except where the law of your country requires otherwise.

12. Changes

We may update these Terms. We'll post the new version at this address and update the effective date. If you keep using AI Marcus after an update, you accept the new Terms.

13. Apple App Store terms

If you downloaded AI Marcus from the Apple App Store:

• These Terms are between you and Sacred Pathway only, not Apple. Sacred Pathway, not Apple, is solely responsible for AI Marcus and its content.
• Your license to use AI Marcus is limited to Apple-branded devices you own or control, as allowed by the App Store Usage Rules.
• Apple has no obligation to provide maintenance or support for AI Marcus.
• If AI Marcus fails to meet any applicable warranty, you may notify Apple, and Apple will refund any purchase price (AI Marcus is free). To the extent allowed by law, Apple has no other warranty obligation for AI Marcus.
• Sacred Pathway, not Apple, is responsible for any claims relating to AI Marcus or your use of it. That includes product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If a third party claims that AI Marcus or your use of it infringes their intellectual property, Sacred Pathway, not Apple, is responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a U.S. government embargo or designated as "terrorist supporting", and that you are not on any U.S. government list of prohibited or restricted parties.
• You must follow any third-party terms that apply when using AI Marcus.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple may enforce these Terms against you.
